SEPERTI YANG DIJANGKA, CERITA DAP DI SARAWAK ADALAH 'TANAH' SAMPAI AKHIRNYA PENGERUSI DAP SARAWAK MALU SENDIRI!!!



Persidangan Sehari Dewan Undangan Negeri (DUN) Sarawak telah menyaksikan perdebatan menarik di antara Ketua Menteri Sarawak Datuk Patinggi Tan Sri (Dr) Adenan Satem dengan Ketua Pembangkang yang juga Pengerusi DAP Sarawak Chong Chieng Jen di sini, pagi tadi.

Persidangan tersebut bertujuan membentangkan Rancangan Malaysia Ke-11 Sarawak bagi tempoh 2016 hingga 2020 bagi melestarikan pembangunan Sarawak menjelang negara maju 2020.

Sepanjang tempoh hampir 4 jam pembentangan yang menyaksikan Adenan menyampaikan pelan perancangan pembangunan Sarawak dalam RMK-11 dengan mendapat sokongan penuh daripada ahli-ahli Barisan Nasional (BN).

Di penghujung pembentangan, Adenan yang berhujah dengan menjawab persoalan yang kerap dibangkitkan Ahli Parlimen Bandar Kuching di Persidangan DUN Sarawak sebelum ini dan di beberapa akhbar Cina dan tempatan Sarawak berhubung isu tanah di Batu Kawa.

Dalam jawapan bertulis dan lisan itu, Adenan telah menjawab segala pertuduhan yang dilemparkan Chong sehingga menyebabkan Ketua Pembangkang itu terpaksa bangun bagi menjawab balas.

Jawapan yang diberikan Chong itu seolah-olah 'menikam' dirinya sendiri apabila Adenan dengan selamba memberitahu menjadi kebiasaan ahli-ahli pembangkang yang cuba mengalih isu yang telah dijawab dengan mengutarakan isu lain bagi mengelak dimalukan.

Keadaan ini menyebabkan Chong marah sehingga ditenteramkan Speaker DUN bagi membolehkan Ketua Menteri Sarawak menyelesaikan bahagian penggulungan pembentangan RMK-11 Sarawak

Bersama ini disertakan transkip jawapan Ketua Menteri Sarawak berhubung dakwaan dan tuduhan Chong Chieng Jen ke atas Kerajaan Negeri Sarawak.

27.05.1996 - Permodalan Assar Sdn Bhd (“ASSAR”) submitted a proposal to the Lands & Surveys Department for the development of the Batu Kawa Township which also involved what is now Lots 128, 5489, 5491, 2301 and 5279 all in Block 225 Kuching Town Land District which has a gross area of 267,15 acres (“the Batu Kawah land”).

08.06 1996 - The then State Planning Committee approved the proposed lay-out plan for the subdivision of the Batu Kawah land into 55 plots subject to various conditions relating to the permitted usages of the 55 plots. The approval was valid for only one year from 08.06.1996 – that means valid until 07.06.1997. The Batu Kawah land was never alienated to ASSAR, and has always remained State Land. The validity period for the approval granted to ASSAR had expired.

25.11.2013 - The Director of Lands & Surveys notified the Architect for Standard Parade Development Sdn Bhd (“SPD”) that provisional approval had been given by the State Planning Authority (“SPA”) for the proposed Mixed Development of the said Batu Kawah Land subject to the State Lands are available for alienation and payment of premium and compliance with other conditions stipulated in the letter from the Director.

08.03. 2014 - The State Government signed Agreement with SPD on the alienation and payment of premium for the Batu Kawah land. The premium was assessed professionally by the Valuers in the Land & Surveys Department, based on provisional approval granted by SPA on the use of each of the blocks within the Batu Kawah land after subdivision including the surrender free of charge of part of the land for infrastuctures like roads, drains, public utilities etc.

01.08.2014 - YB Chong Chieng Jen urged the Chief Minister to stop the alienation of Batu Kawah land to SPD and that the said land be used for affordable housing, with the construction of flats equipped with full recreational facilities and two primary schools.

29.04.2015 - After YB Chong raised the issue in the Dewan Undangan Negri, YAB Chief Minister asked YB Chong to find a purchaser for the Batu Kawah Land who is prepared to pay RM550 million within 30 days.

07.06.2015 - After the expiry of the 30 days period, YB Chong wrote to YAB Chief Minister and announce at a Press Conference that he had found an unidentified and mysterious purchaser who was willing to pay RM 620 million “worth” (including cash payment of RM 490 million).

No formal offer was made by the unidentified and mysterious purchase was made to the Lands & Surveys Department despite the Honourable Member for Semop advising him in the media, to ask this unidentified and mysterious person to submit his proposed offer to the Director of Lands & Surveys.The Government could not deal with proxies of those who want to buy Government land.

Up to date, the Government still does not know who the unidentified and mysterious buyer is. No offer has been received from that person to buy and develop the land. Neither is the Government in the position to determine if this unidentified and mysterious person has the financial resources to buy the land and develop it in accordance with plans approved by SPA. The Government, in the public interest, has a duty to ensure there is a person who is not only willing but also able to buy and develop the Batu Kawah Land.

The Government is therefore fully entitled to conclude that the unidentified and mysterious purchaser, is a figment of YB Chong’s imagination, to avoid conceding that he fails to find a buyer for at least RM550 million which he claims he could find.

12.08.2015 – Having failed to surface a genuine willing and able buyer for the land, and suspecting that I would deal with this matter in this august House today, he made new allegations to the media, on the alienation of the Batu Kawah Land, namely:

(a) The Batu Kawah Land was “hijacked” from ASSAR, a government linked company to benefit two shareholder of SPD;

(b) Conflict of interests by State Ministers approving the alienation of land for the construction of a building for SABATI, an NGO in which the wives of Ministers are office bearers.

On (a), the land was never alienated to ASSAR and the Government’s approval for ASSAR’s plans to develop the land had long expired in June, 1997, without ASSAR complying with the conditions stipulated for its approval.

On (b) – according to Clause 2 of the Constitution of SABATI (a registered Society) its objects are to carry out charitable works and activities, for the relief of poverty, infirmed and aged, and the advancement of sports, culture, education and religion.

Clause 10 (1)(a) of the Constitution states that the “income and funds of SABATI shall be applied solely towards the promotion of its charitable objects and causes and no portion thereof shall be paid or transferred directly or indirectly or in any way whatsoever by way of profit or dividend to its members.”

The Government is assisting SABATI as an NGO carrying out charitable works and activities for the benefit of the Community, in the same manner as the Government is also assisting other similar charitable organisations like the Red Crescent, Cheshire Home, Society for the Blind, Kidney Association of Sarawak and many others. The Government wants all these charitable bodies to perform their role of helping the community in need of help, effectively and sustainably.

YB Chong checkmated, unable to produce a genuine buyer. The unidentified & mysterious purchaser is a figment of Chong’s imagination. - (
